The Court affirmed summary judgment on Gallipo’s seniority-based property-right and contract claims, his personnel-regulation, emotional-distress, and state-constitutional claims, and affirmed the denial of his motion to disqualify the trial judge.
The court upheld the transfer of custody to the mother because the trial court’s finding of sexual abuse supported a substantial change in circumstances and was not clearly erroneous.
The Vermont Supreme Court reversed the family court’s permanent equalization of the parties’ net incomes, holding that such a permanent formula was an abuse of discretion, and remanded for a proper maintenance award that may include a limited equalization period but not a permanent one.
