Supreme Court of the United States
Tc Heartland LLC, Petitioner v. Kraft Foods Group Brands LLC.
May 22, 2017197 L. Ed. 2d 816
Summary
Justice Thomas delivered the opinion of the Court, holding that a domestic corporation resides only in its State of incorporation for purposes of the patent venue statute, 28 U.S.C. § 1400(b). Congress's amendments to the general venue statute, § 1391, did not alter the meaning established in Fourco. The amended statute supplies no clear indication of such a change, and its saving clause expressly accommodates specialized venue rules. The Court reversed the Federal Circuit's judgment and remanded. It left questions concerning petitioner's potentially unincorporated status and venue for foreign corporations unresolved. All participating Justices joined; Justice Gorsuch did not participate. There were no separate opinions.
Holding
- Whether § 1391's amended definition of residence governs domestic corporations under the patent venue statute.. A domestic corporation resides only in its State of incorporation for purposes of § 1400(b); the amendments to § 1391 did not change that interpretation.
