Supreme Court of the United States
Noel Reyes Mata, Petitioner v. Loretta E. Lynch
June 15, 2015135 S. Ct. 2150
Summary
The Supreme Court held that a federal court of appeals has jurisdiction to review a Board of Immigration Appeals denial of a motion to reopen removal proceedings, even when the motion is dismissed as untimely. The Court further ruled that the Board’s separate sua sponte decision not to reopen the case does not divest the appellate court of that jurisdiction. Accordingly, the Fifth Circuit’s dismissal for lack of jurisdiction was reversed and the case remanded for further proceedings.
