The Court held that the "clearly established Federal law" requirement of 28 U.S.C. §2254(d)(1) is measured at the time a state court adjudicates a claim on the merits, not at the point a conviction becomes final. Because the Pennsylvania Superior Court’s decision predated the Supreme Court’s ruling in Gray, that decision was not contrary to or an unreasonable application of clearly established Federal law, and Greene’s habeas petition was barred. The judgment of the Third Circuit was affirmed.
