Supreme Court of the United States

Florida v. Powell

February 23, 2010559 U.S. 50

Summary

The Court held that it had jurisdiction because the state court's decision appeared interwoven with federal law and did not clearly rest on an independent state ground. It further held that the Tampa police warnings reasonably conveyed a suspect's right to have counsel present throughout interrogation and therefore satisfied Miranda. The judgment was reversed and remanded. Justice Stevens, dissenting, would have dismissed for lack of jurisdiction and would have held that the warnings inadequately conveyed the right to counsel's presence.
