Summary
The Supreme Court unanimously agreed the National Labor Relations Board properly placed the burden of proving supervisory status on the employer. However, the Court held the Board's interpretation excluding professional judgment from independent judgment was unlawful. Because the Board relied on this flawed interpretation, the Court affirmed the Sixth Circuit’s judgment denying enforcement. Justice Stevens concurred in part and dissented in part, arguing the Board’s interpretation was permissible and a remand would have been proper.
