Summary

The Court held that the Eleventh Amendment does not bar Kansas from recovering monetary damages from Colorado for violating the Arkansas River Compact, even if some damages reflect losses to individual citizens. It also held that prejudgment interest may be awarded on unliquidated claims but should accrue from 1985 rather than 1969 based on equitable considerations. Justice O'Connor concurred in part and dissented in part, arguing prejudgment interest was improper under the law existing when the Compact was negotiated.
