Supreme Court of the United States
Calderon v. Thompson
April 29, 1998523 U.S. 538
Summary
The Court held that the Ninth Circuit's sua sponte recall of its mandate did not violate AEDPA's successive-application provisions because it rested exclusively on Thompson's first federal habeas petition. Nevertheless, recalling a mandate to reconsider the merits of a denial of habeas relief to a state prisoner is an abuse of discretion unless necessary to avoid a miscarriage of justice under the Court's actual-innocence standards. Thompson's additional impeachment and forensic evidence failed to satisfy those standards. The Court reversed and remanded with instructions to reinstate the mandate denying relief. Justice Souter, joined by Justices Stevens, Ginsburg, and Breyer, dissented, arguing that ordinary, deferential abuse-of-discretion review governed and permitted the Ninth Circuit to correct procedural failures that may have prevented consideration of a constitutional error affecting Thompson's death eligibility.
Holding
- Whether AEDPA barred the recall of the mandate.. The recall did not contravene the terms of 28 U.S.C. § 2244(b) because the Ninth Circuit acted exclusively on Thompson's first federal habeas application, without considering claims or evidence from later filings.
- What limits govern sua sponte recall of a mandate denying federal habeas relief.. A federal court of appeals abuses its discretion when it sua sponte recalls its mandate to revisit the merits of an earlier denial of habeas relief to a state prisoner unless it acts to avoid a miscarriage of justice as defined by the Court's habeas jurisprudence.
- Whether Thompson satisfied the miscarriage-of-justice standard.. Thompson's evidence failed both the more-likely-than-not standard applicable to innocence of the rape conviction and the clear-and-convincing standard applicable to innocence of the rape special circumstance establishing death eligibility.
