Supreme Court of the United States
Calderon v. Moore
June 17, 1996518 U.S. 149
Summary
The Court held per curiam that California's appeal from an order granting habeas relief was not moot merely because the State had arranged a new trial in compliance with that order. Because the retrial had not begun, a favorable appellate decision could still relieve the State of the burden of conducting it. The Court reversed the Court of Appeals' dismissal and remanded for further proceedings. There were no separate opinions.
Holding
- Mootness of the State's appeal after arranging a new trial pursuant to a habeas order.. The appeal was not moot because a favorable appellate decision could relieve the State of the burden of conducting the new trial.
