Supreme Court of the United States

Board of County Commissioners, Wabaunsee County, Kansas v. Umbehr

June 28, 1996518 U.S. 668

Summary

The Court, in an opinion by Justice O'Connor, held that independent government contractors receive First Amendment protection against retaliatory termination or nonrenewal of existing contracts. The Pickering balancing test applies, adjusted to consider the government's interests as contractor rather than employer. The Court affirmed the Tenth Circuit and remanded for consideration of causation, the government's defenses, and the competing interests; it reserved whether applicants for new contracts receive similar protection. Chief Justice Rehnquist joined all but Part II–B-1, and Justices Stevens, Kennedy, Souter, Ginsburg, and Breyer joined the entire opinion. Justice Scalia, joined by Justice Thomas, dissented, arguing that historical practice did not support constitutional restrictions on patronage contracting, that regulation should remain with elected institutions, and that the Court's approach would generate costly and uncertain litigation.

Holding

  • First Amendment protection for independent contractors with existing government contracts.. Independent government contractors are protected against termination or nonrenewal of existing contracts in retaliation for protected speech, subject to Pickering balancing adjusted to the government's interests as contractor. The Court did not decide the rights of bidders or applicants lacking a pre-existing commercial relationship.
  • Requirements and defenses for Umbehr's retaliation claim.. Umbehr must show that speech on a matter of public concern motivated termination of his contract. The Board may prevail by proving by a preponderance of the evidence that it would have terminated the contract regardless of that speech, or by establishing that its legitimate interests as contractor, deferentially viewed, outweigh the free speech interests.
