Summary

The Supreme Court reversed Jenkins's conviction for distributing the film "Carnal Knowledge," holding that the film does not meet the Miller test for obscenity and therefore is protected by the First and Fourteenth Amendments. Justice Brennan, in a concurring opinion, agreed with the reversal but argued that Georgia's obscenity statutes are facially overbroad.
