Wisconsin Supreme Court
Kathleen M. Hansen, Plaintiff-Appellant v. A.H. Robins Company, Inc., Defendant-Appellee
July 1, 1983113 Wis. 2d 550
Summary
The court adopted the discovery rule for tort claims not already governed by a legislatively created discovery rule, holding that accrual occurs when the injury is discovered or reasonably should have been discovered, whichever occurs first. Applying that rule, the court held that Hansen's claim accrued when her pelvic inflammatory disease was diagnosed and that her complaint was timely. The certified question was answered and the matter was remanded for further proceedings.
