West Virginia Supreme Court
State of West Virginia, Plaintiff Below, Appellant v. David Wayne Kaufman, Defendant Below, Appellee
June 22, 2011227 W. Va. 537
Summary
The court reversed Kaufman's first-degree murder conviction and life-without-mercy sentence because the trial court improperly admitted the victim's entire sixty-three-page diary as a single hearsay statement and failed to adequately explain its admission of related statements made to others. The court held that the diary was nontestimonial for Confrontation Clause purposes, but required each declaration or remark to be separately evaluated for hearsay, relevance, admissibility, and unfair prejudice. Chief Justice Workman, concurring, emphasized that the hearsay inquiry must first determine whether each statement is hearsay at all.
Holding
- Whether the victim's diary was testimonial under the Confrontation Clause.. The diary was nontestimonial because the circumstances did not objectively indicate that the victim expected it to be used at a later criminal trial; therefore, its admission did not violate the Confrontation Clause on testimonial-statement grounds.
- Whether a lengthy narrative diary may be admitted as one statement under the hearsay rules.. When ruling on a narrative offered under the hearsay rules, the trial court must break it down and determine the separate admissibility of each single declaration or remark, including whether it is hearsay, relevant, admissible under an exception, and subject to exclusion because of unfair prejudice.
- Whether admission of the diary and statements made by the victim to other witnesses required reversal.. The trial court abused its discretion by admitting the entire diary as a single statement and erred by admitting the victim's statements to others without stating the factual and legal basis for the ruling. Because the diary was central to the State's case and highly prejudicial in light of the lack of physical evidence, Kaufman was entitled to a new trial.
