The Washington Supreme Court affirmed Thorgerson’s convictions, concluding that the prosecutor’s references to otherwise inadmissible consistent statements did not create a substantial likelihood of affecting the verdict, and that the prosecutor’s improper attack on defense counsel was not prejudicial.
The court held that Grier’s agreement to withdraw lesser-included-offense instructions did not bar her ineffective-assistance claim, because the decision ultimately rests with counsel after consultation with the defendant.
