Washington Supreme Court
The State of Washington, Respondent v. Duggie Alberg, Appellants
April 17, 1930156 Wash. 397
Summary
The court held that the superior court improperly dismissed the defendants' appeals for lack of diligence because less than six months had elapsed and no jury term had occurred during which the cases could have been tried. It also held that the defendants' guilty pleas did not bar appellate review because affidavits overcame the justice court records and established that no properly verified complaints were on file when the defendants were sentenced. The judgments dismissing the appeals were reversed and the causes remanded. Holcomb, J., and Fttllertoh, J., dissented, contending that the justice court's certified records could not be overcome in this manner and that the superior court had not manifestly abused its discretion.
Holding
- Dismissal for failure to diligently prosecute. The appeals could not properly be dismissed for lack of diligence because less than six months had elapsed between the appeals and the motions to dismiss, no jury term had been held in the county, and the cases could not have been tried earlier even if the transcripts had been promptly filed.
- Effect of guilty pleas on appeals from justice court. The guilty pleas did not waive the defendants' right to appeal and challenge the legality of the proceedings because the defendants' affidavits sufficiently overcame the justice court records and showed that no properly verified complaints were on file when they were adjudged guilty and sentenced.
