Supreme Court of Virginia

Larsen v. Stack

May 28, 2020

Summary

The Supreme Court of Virginia affirmed the circuit court’s construction of Erik Larsen’s will. It held that Sandra received a limited right to reside on the house and farm while physically and mentally able to do so, rather than a life estate; Pamela and Kirk retained concurrent rights to use and access the property subject to noninterference with Sandra’s residence. The court also held that parol evidence was properly admitted to resolve ambiguities concerning the scope and termination of Sandra’s right to reside.
