Summary

The Court held that Richards could use Rule 75 to obtain judicial review of the selectboard’s quasi-judicial septic-permit decision because he raised a substantial legal question rather than seeking factual review. It also held that his allegations that he owned abutting land and faced a potential nuisance from a noncompliant septic system adequately alleged a threatened injury in fact and therefore established standing. The Court reversed the dismissal.
