Supreme Court of Vermont
Appendix in Re: Constitutionality of House Bill 88.
July 6, 1949115 Vt. 524
Summary
The Vermont Supreme Court declined the Governor's request for advisory opinions on the constitutionality of House Bill No. 88 and related questions concerning House Bill No. 40. It concluded that the Vermont Constitution limits the judicial power to deciding actual controversies between adverse litigants, and that the Legislature could not expand that power by statute. The court stated that House Bill No. 88 was therefore unconstitutional and did not address House Bill No. 40.
