Supreme Court of Pennsylvania

Daub's Estate.

October 2, 1931305 Pa. 446

Summary

The court reversed the decree vacating the widow's election to take under the will. It held that a petition to revoke such an election ordinarily must be filed within the statutory election period and that the widow's delay of more than five years, coupled with the absence of actual fraud and the loss of material evidence, barred equitable relief. No separate opinions were filed.
