Summary

The Court of Appeals held that Family Court improperly admitted videos purportedly depicting sexual abuse because the proponent failed to establish their authenticity through a sufficient foundation. The court concluded that the unusual source of the videos, their incomplete chain of custody, and the lack of testimony establishing that the recordings accurately depicted the events rendered the authentication evidence legally insufficient. It therefore reversed the Appellate Division and dismissed the petitions.
