MaineState of Maine v. Edwin J. Shepard

August 5, 19741974 Me. LEXIS 312

The court held that blood-alcohol test results were properly admitted against a motorist who was lawfully arrested for operating under the influence. Under Maine's implied-consent statute, operating a motor vehicle itself constitutes consent to chemical testing, so no additional affirmative consent was required.
