Supreme Court of Iowa
John Phillip Metz Iii, Joann Metz, Jaime M. Metz, and John P. Metz, Iv, Appellants v. Amoco Oil Company, a Foreign…
July 1, 19981998 Iowa Sup. LEXIS 138
Summary
The court affirmed dismissal of the Metzes’ toxic-exposure action and the resulting default judgment because their appellate challenges were either unsupported by the record or not preserved in the district court. Although the court recognized that a litigant has a right to proceed without counsel and criticized the manner in which the trial court handled counsel’s withdrawal, it held that the Metzes had not asserted that right below and that their other challenges to the default judgment were likewise waived. Justice Lavorato, joined by Justice Carter, dissented and would have reversed and remanded because the trial court lacked authority to condition prosecution of the action on obtaining counsel and should have granted relief from the default for excusable neglect.
Holding
- Expansion of the appellate record. The affidavits could not be added to the appellate record because the motion to expand the record was filed outside the mandatory filing period.
- Right to proceed pro se and due process. The Metzes’ constitutional challenge failed because they did not assert a right to proceed pro se in the district court, and the record did not show that the trial court misled them about that right. The court nevertheless recognized that the trial court lacked authority to require them to obtain counsel as a condition of continuing the action.
- Challenges to the default judgment. The Metzes waived their claims that they lacked notice and an opportunity to be heard, that the district court abused its discretion by entering default judgment sua sponte, and that the court failed to find willfulness, fault, or bad faith.
- Refusal to set aside or vacate the default judgment. The court could not review the claimed abuse of discretion in refusing to set aside or vacate the default judgment because the Metzes failed to identify and present any legally cognizable grounds for relief in the district court.
