Supreme Court of the United States

Trump v. California

August 24, 2026

Summary

The Court, per curiam, granted the Government’s application to stay the District Court’s injunction pending appellate review and denied Alabama’s separate stay application as moot. It concluded that the Government was likely to prevail on its argument that the States lacked standing and their challenges were unripe: the Executive Order’s internal directives imposed no obligations on the States, and injuries from possible implementation remained speculative. The injunction’s interference with Executive Branch operations established likely irreparable harm, and the equities favored relief. The Court did not decide whether future implementation would be lawful. Justice Sotomayor, joined by Justice Kagan, dissented, finding credible prosecution threats and present injuries sufficient for justiciability and rejecting the Government’s asserted irreparable harm. Justice Jackson separately dissented, arguing that the record established actual and imminent injuries, the Government had not established harm from restrictions on allegedly unlawful conduct, and a stay threatened electoral disruption.

Holding

  • Justiciability of the challenge to Section 2(a).. The Government was likely to prevail on its contention that the States could not presently challenge the Citizenship List directive.
  • Standing to challenge Section 2(b).. The States lacked standing to challenge the President’s directive prioritizing investigations and prosecutions under existing election laws.
  • Justiciability of the challenge to Section 3.. The States could not establish a present Article III injury from an internal directive to initiate rulemaking that might eventually produce binding requirements.
  • Irreparable harm pending appeal.. The Government demonstrated likely irreparable harm from leaving the injunction in place.
  • Balance of equities.. The balance of equities did not counsel against granting interim relief.
