Supreme Court of the United States
First Choice Women's Resource Centers, Inc. v. Davenport
April 29, 2026224 L. Ed. 2d 672
Summary
Justice Gorsuch, writing for a unanimous Court, held that First Choice established a present injury to its First Amendment associational rights sufficient for Article III standing to challenge the Attorney General’s demand for private donor information. The demand’s objectively reasonable chilling effect exists while the subpoena remains outstanding, even if judicial enforcement is required. First Choice need not await state-court enforcement, and neither exempting some donation channels nor promising confidentiality eliminates the injury. The Attorney General’s proposed narrowing also did not moot the case. The Court reversed and remanded without deciding the merits of the constitutional challenge. There were no separate opinions.
Holding
- Present injury from the demand for private donor information.. First Choice established a present injury to its First Amendment associational rights sufficient to satisfy Article III’s injury-in-fact requirement.
- Need to await judicial enforcement of a non-self-executing subpoena.. The subpoena’s non-self-executing character does not defeat standing or require First Choice to await state-court enforcement before bringing this §1983 action.
- Effect of exempting one donation channel.. Allowing anonymous donations through one website does not eliminate First Choice’s associational injury.
- Mootness resulting from proposed narrowing of the subpoena.. The Attorney General’s willingness to narrow the demand did not moot the case.
- Effect of anticipated confidentiality protections.. A prospective protective order restricting public disclosure would not eliminate the associational injury.
