Summary

The Court held that under 18 U.S.C. §1028A(a)(1) a defendant "uses" another person's means of identification "in relation to" a predicate offense only when that use is at the crux of the criminal conduct, requiring a genuine nexus between the identification and the fraud. Accordingly, the Fifth Circuit’s judgment was vacated and the case remanded for further proceedings consistent with this interpretation.
