Summary

The Supreme Court held that the 1868 treaty establishing the Navajo Reservation reserves water necessary to fulfill the reservation’s purpose but does not obligate the United States to take affirmative steps to secure water for the Tribe. Accordingly, the Court reversed the Ninth Circuit’s judgment that imposed such a duty.
