Summary

The Court denied certiorari without addressing the merits of the Fifth Circuit’s qualified-immunity ruling. Justice Sotomayor, joined by Justices Breyer and Kagan, dissented. She would have summarily reversed because the complaint plausibly alleged that officers knowingly ignited a gasoline-soaked man by tasing him, causing his death and destroying his family’s home. She maintained that the Fifth Circuit improperly disregarded well-pleaded allegations at the motion-to-dismiss stage and that knowingly causing the very danger the officers purportedly sought to prevent was clearly unreasonable.
