The Supreme Court reversed the Third Circuit, holding that PASPA’s prohibition on state authorization (and by extension licensing) of sports gambling violates the anticommandeering principle of the Tenth Amendment and that no provision of PASPA is severable from the invalid portions. The Court therefore struck down the statute.
