Supreme Court of the United States

American Broadcasting Companies, Inc., Petitioners v. Aereo, Inc., Fka Bamboom Labs, Inc.

June 25, 2014134 S. Ct. 2498

Summary

The Court held that Aereo infringes copyright owners' exclusive right to perform works publicly under the Copyright Act. Aereo's system, which allows subscribers to watch over-the-air broadcasts over the internet using individual antennas and personal copies, is functionally equivalent to cable systems Congress intended to cover under the 1976 amendments. Justice Breyer, dissenting, would have affirmed on the ground that Aereo does not make volitional choices to select content.
