Supreme Court of the United States
Arizona, Petitioners v. the Inter Tribal Council of Arizona, Inc. — Alito, J., Dissenting
June 17, 2013570 U.S. 1
Summary
Justice Alito dissented from the Court's interpretation of the National Voter Registration Act, arguing that the Act does not clearly pre-empt Arizona's requirement that voter-registration applicants provide proof of citizenship. He reasoned that the Constitution reserves voter qualifications and their enforcement to the States and that the statute should be read, under the presumption against pre-emption and constitutional-avoidance principles, to permit supplemental information. Justice Thomas, dissenting, likewise would have held that Arizona may require additional information to verify voter eligibility.
