Supreme Court of the United States
Clinton v. Goldsmith
May 17, 1999526 U.S. 529
Summary
Justice Souter, writing for a unanimous Court, held that the Court of Appeals for the Armed Forces lacked jurisdiction to issue an injunction under the All Writs Act to prevent the President and other officials from dropping the respondent from the Air Force rolls, and therefore reversed the CAAF’s judgment. No separate opinions were filed.
Holding
- Whether the All Writs Act permits the CAAF to enjoin the President from dropping a service member from the rolls.. The Court held that the All Writs Act does not grant the CAAF jurisdiction to issue such an injunction because the action is not "in aid of" the CAAF’s limited jurisdiction over court‑martial findings and sentences.
