Supreme Court of the United States
Yellow Freight System, Inc. v. Donnelly
April 17, 1990494 U.S. 820
Summary
In a unanimous opinion by Justice Stevens, the Court held that state courts have concurrent jurisdiction over civil actions brought under Title VII. Congress did not overcome the presumption of concurrent state-court jurisdiction through Title VII’s text, legislative history, or procedural provisions. Legislative expectations that litigation would proceed exclusively in federal court did not establish a legislative decision to exclude state courts. The Court affirmed the Seventh Circuit’s judgment. There were no separate opinions.
