Supreme Court of the United States
Dugger v. Adams
February 28, 1989489 U.S. 401
Summary
Justice White's majority opinion held that Caldwell v. Mississippi did not establish cause for Adams's procedural default because an available state-law objection to the jury instructions was a necessary element of his later Caldwell claim. The Court also upheld the adequacy of Florida's procedural bar and rejected Adams's asserted fundamental-miscarriage-of-justice exception, without deciding whether the instructions actually violated Caldwell. Justice Blackmun dissented, joined by Justices Brennan, Marshall, and Stevens. Although he accepted the conclusion that Adams lacked cause for his default, he maintained that Florida had inconsistently applied its procedural bar and that the alleged distortion of the jury's sentencing responsibility warranted review under the fundamental-miscarriage-of-justice exception.
Holding
- Whether Caldwell supplied cause for Adams's procedural default.. Caldwell did not supply cause because Adams could have challenged the instructions under state law, and that state-law defect was a necessary element of his later Caldwell claim.
- What a defendant must establish to show a Caldwell violation.. A defendant must show that the challenged remarks improperly described the jury's role under local law; an accurate description of that role does not establish a Caldwell violation.
- Whether Florida's procedural bar constituted an adequate state ground.. The identified Florida decisions did not undermine the adequacy of the rule barring postconviction claims that were not raised on direct appeal.
- Whether the fundamental-miscarriage-of-justice exception excused Adams's default.. Adams did not establish a fundamental miscarriage of justice merely by alleging an instruction error affecting sentencing accuracy and pointing to an equal number of aggravating and mitigating circumstances.
