Supreme Court of the United States
Holt Civic Club v. City of Tuscaloosa
November 28, 1978439 U.S. 60
Summary
The Court held that Alabama's statutory system authorizing cities to exercise limited police, sanitary, licensing, and criminal jurisdiction beyond their corporate limits does not violate the Equal Protection or Due Process Clauses merely because residents of the surrounding police jurisdiction cannot vote in the city's municipal elections. Because the residents live outside the city's geographic boundaries, the voting qualification was not subject to heightened scrutiny, and the statutory scheme was rationally related to legitimate state purposes. Justice Stevens concurred to emphasize the limited scope of the holding, while Justice Brennan, joined by Justices White and Marshall, would have invalidated the statutes under heightened equal-protection scrutiny.
Holding
- Three-judge district court jurisdiction. The three-judge District Court was properly convened because the challenged statutes established a statewide system governing the extraterritorial exercise of municipal powers.
- Equal Protection Clause and municipal voting rights. The Equal Protection Clause does not require Alabama to extend Tuscaloosa's municipal franchise to residents who live outside the city's corporate limits but within its police jurisdiction.
- Due Process Clause. The challenged statutes do not violate due process by subjecting police-jurisdiction residents to limited municipal regulation without granting them the right to vote in Tuscaloosa elections.
