January 25, 1977429 U.S. 477

Justice Marshall delivered the opinion of the Court, holding that plaintiffs seeking treble damages for Clayton Act § 7 violations must establish antitrust injury: injury of the type the antitrust laws were intended to prevent that flows from what makes the challenged conduct unlawful.

SCOTUSBoston Stock Exchange v. State Tax Commission

January 12, 1977429 U.S. 318

The Court held that New York's amended securities-transfer tax violated the Commerce Clause because it imposed a substantially heavier burden on out-of-state sales than on comparable in-state sales, thereby favoring New York exchanges.
