Supreme Court of the United States
Puyallup Tribe, Inc. v. Department of Game of Washington
June 23, 1977433 U.S. 165
Summary
The Court held that Washington courts could not impose relief directly against the Puyallup Tribe without a waiver or consent, although they could adjudicate and regulate the fishing activities of individual tribal members. It rejected the Tribe’s claim to exclusive, unregulated on-reservation steelhead fishing and upheld the conservation-based allocation of 45% of the natural steelhead run to treaty net fishing. The judgment was vacated insofar as it directed relief against the Tribe and the case was remanded for further proceedings. Justice Brennan, joined by Justice Marshall, dissented in part, contending that the treaty reserved exclusive on-reservation fishing rights and that the case should be remanded to determine only necessary conservation measures; Justice Blackmun concurred while questioning the continuing vitality of tribal immunity doctrine.
Holding
- Direct relief against the Tribe and tribal sovereign immunity. Absent an effective waiver or consent by the Tribe or Congress, a state court may not exercise jurisdiction over a recognized Indian tribe or impose relief directly against it. The portions of the state-court order directed to the Tribe itself therefore had to be vacated.
- Effect of tribal participation on immunity. The Tribe’s appearance and representation of its individual members did not constitute a waiver of the Tribe’s sovereign immunity.
- State regulation of treaty fishing and claimed exclusive on-reservation fishing rights. The Tribe did not possess an exclusive right to take steelhead while the fish passed through its reservation, and the state courts could regulate the treaty fishery in the interest of conservation, including on-reservation fishing under the circumstances presented.
- Adequacy of the conservation allocation. The Court found no basis to disturb the state courts’ determination that 45% of the annual natural steelhead run available for taking should be allocated to treaty net fishing.
