Supreme Court of the United States
United States ex rel. Knauff v. Shaughnessy, Acting District Director of Immigration and Natu — Frankfurter, J…
January 16, 1950338 U.S. 537
Summary
Justice Frankfurter, dissenting, would have construed the War Brides Act to protect alien spouses of honorably serving or discharged American servicemen from summary exclusion based on undisclosed security information absent explicit congressional authorization. He reasoned that applying the executive regulation in this context would frustrate the Act's family-centered purpose and allow an administrative officer to defeat the statutory benefit by implication. Justice Jackson, joined by Justices Black and Frankfurter, likewise would have required production of the exclusion evidence or admission of the alien spouse.
