Supreme Court of the United States

Graver Tank & Mfg. Co., Inc. v. Linde Air Products Co.

February 28, 1949336 U.S. 271

Summary

The Court reinstated the District Court's judgment concerning the Jones patent. It upheld the validity and infringement findings for four flux claims, agreed that other flux and process claims were invalid, and accepted the finding that the patent had not been misused. The Court deferred to the concurrent factual findings of the lower courts because they were not clearly erroneous.

Holding

  • Validity and infringement of flux claims 18, 20, 22, and 23. Claims 18, 20, 22, and 23 validly claimed a patentable invention, and the accused flux infringed each claim.
  • Validity of flux claims 24 and 26. Claims 24 and 26 were invalid because their unqualified references to silicates and metallic silicates covered more than the demonstrated invention and could not be narrowed by resort to the specifications.
  • Validity of the process claims and claim 27. The process claims and claim 27 were invalid. Some process claims failed to specify the essential chemical constituents of the welding composition, while others improperly claimed the old welding procedure as though the welding composition alone conducted the current and no electric arc was present.
  • Alleged misuse of the patent. The patent had not been misused, and the patent owner could maintain an infringement action on the valid portion of the patent.
