Supreme Court of the United States
Weightman v. Caldwell
February 15, 181917 U.S. 85
Summary
The Court affirmed a judgment on a promissory note arising from the purchase of the plaintiff's interest in a cargo at sea. Although the written memorandum was signed only by the buyer, the trial court properly permitted the jury to determine whether the agreement had been actually executed by both parties, which could remove the transaction from the statute of frauds. The Court declined to decide the underlying legal issue because the defendant received all the benefit the law allowed on the record.
Holding
- Whether the trial court properly submitted the question of actual execution of the agreement to the jury.. Yes. The trial court was clearly correct to submit to the jury whether the agreement had been executed by both parties, and the judgment was therefore affirmed.
