The court affirmed the denial of Officer Blake’s motion to dismiss on qualified-immunity grounds, holding that Anderson plausibly alleged a protected privacy interest in a video of her alleged rape and that the right was clearly established when the video was disclosed.
The court affirmed the lack of personal jurisdiction over the Virginia officials but vacated the dismissal rather than transfer and remanded for the district court to decide whether transfer is in the interests of justice.
