The court held that the Estate’s allegations, viewed favorably to it, supported denying qualified immunity to the correctional officers, paramedic Tipton, and Dr. Boduch, but not to paramedic Rose or supervisors Yager, Haggard, and Wright.
The court affirmed dismissal of Grinter’s due process claims and his § 1981 claim, concluding that the alleged restraint, disciplinary-procedure, good-time-credit, and supervisory conduct did not establish a viable claim, and that his race-discrimination allegation was conclusory.

The court affirmed dismissal of Bassett’s antitrust claim because the complaint did not allege commercial NCAA enforcement activity or antitrust injury to a market, and because his conspiracy theory depended on claims against alleged co-conspirators whose dismissal he did not appeal.

The en banc court affirmed Vonner’s 117-month sentence, holding that judicial factfinding to calculate an advisory Guidelines range did not violate the Sixth Amendment and that his within-Guidelines sentence was reasonable.
