Summary

The court held that the miners were disqualified from receiving unemployment compensation because their unemployment resulted from a stoppage of work caused by a labor dispute over the terms of a new employment agreement. The dispute existed even though the prior contract had expired and the parties continued negotiating, because the employment relationship continued and the parties were unable to agree on provisions such as a union shop. The circuit court's denial of benefits was affirmed. Lovins, Judge, dissenting, would have treated the unemployment as resulting from the absence of a new contract and would have reversed.
