Washington Supreme Court
The State of Washington, Appellant v. Allen White, Respondent
February 18, 198297 Wash. 2d 92
Summary
The court held that RCW 9A.76.020(1) and (2), which criminalized refusing to provide information lawfully required by a public servant and making an untrue statement in response, were unconstitutionally vague. It further held that the arrest and prolonged detention under the statute were unreasonable and that the evidence and confession obtained as a result had to be suppressed under the Washington Constitution. The judgment invalidating the statute and suppressing the evidence was affirmed.
