Utah Supreme Court
State of Utah, Plaintiff and Petitioner v. Wallace Wayne Dean, Defendant and Respondent
July 27, 2004505 Utah Adv. Rep. 3
Summary
The Utah Supreme Court reversed the Utah Court of Appeals and affirmed the trial court’s denial of Wallace Dean’s motion to withdraw his guilty plea. The Court held that the trial court’s omission of the words “speedy public trial before an impartial jury” was not obvious error and that Dean failed to show prejudice, so no plain error existed. The Court also affirmed that appellate review of a denial of a motion to withdraw may consider the plea colloquy and statement.
