Summary
The Tennessee Supreme Court held that defendants in an employee's personal-injury tort action may not plead the negligence of the employee's workers'-compensation-immune employer as an affirmative defense to reduce their comparative-fault liability. Comparative fault may be attributed only to the plaintiff and persons against whom the plaintiff has a tort cause of action. The court reversed the Court of Appeals and remanded for further proceedings.
