Summary

The South Carolina Supreme Court held that the trial court’s incomplete jury instruction on the lesser‑included offense of first‑degree domestic violence was error but harmless, and therefore reinstated the defendant’s conviction for domestic violence of a high and aggravated nature (DVHAN). The Court affirmed the Court of Appeals’ finding that the instruction was erroneous, but reversed its determination that the error was not harmless.
