Summary
The South Carolina Supreme Court held that the family court retains subject‑matter jurisdiction to modify alimony even when a divorce decree labels the award “nonmodifiable.” It further held that subsection 20‑3‑130(G) does not strip the court of that jurisdiction and that the alimony recipient’s failure to contest the 2011 modification waived her right to invoke the nonmodifiable provision later. Accordingly, the Court reversed the Court of Appeals’ vacatur of the 2018 termination order and reinstated the family court’s order terminating alimony.
