Summary

The Supreme Court of South Carolina affirmed the conviction, holding that section 56‑5‑2946 is facially constitutional but, as applied, the warrantless blood draw violated the Fourth Amendment and the state constitution; however, the evidence was admitted because the officers acted in good faith.
