Supreme Court of Rhode Island

Paula J. DiPAOLA v. Anthony DiPAOLA

March 11, 20112011 R.I. LEXIS 29

Summary

The Rhode Island Supreme Court held that the marital settlement agreement’s paragraph 7.D was ambiguous and, under an equitable construction, entitled the wife to one‑half of all of the husband’s stock options earned during the marriage, including those that vested after the agreement. Accordingly, the Court vacated the Family Court’s order and remanded for entry of an award of half the net proceeds of the stock options.
