Supreme Court of Rhode Island

David H. Haffenreffer v. Karl Haffenreffer…

May 18, 20102010 R.I. LEXIS 64

Summary

The Supreme Court of Rhode Island reversed and vacated the Superior Court's summary judgments, holding that the phrase “Estate of Carolyn B. Haffenreffer” in the offer document unambiguously includes the overall estate (probate estate and trust) and therefore Karl Haffenreffer was entitled to use a credit from his share of the overall estate; the case was remanded for further proceedings. Justice Goldberg dissented, arguing the contract was clear and unambiguous and should be enforced as written.
